Welcome to Captain’s Catch. These Terms and Conditions (“Terms”) apply to your use of our website https://captains-catch.co.uk and to all orders you place with us, whether in person, by phone, or through any online ordering features we may introduce in the future.
By accessing or using our website, or by placing an order for our food (takeaway or dine-in), you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or place any orders with us.

We specialise in serving high-quality, freshly prepared fish and chips, along with other classic hot food items. Our goal is to provide tasty, satisfying meals with consistent quality and friendly service.
- Use of the website Our website is provided for your personal, non-commercial use only. You agree not to:
- copy, reproduce, modify, distribute or create derivative works from any part of the website without our written permission
- use the website for any unlawful purpose or in any way that could damage, disable, overburden or impair the site
- attempt to gain unauthorised access to the website, our servers, or any related systems
- transmit any viruses, malware, or harmful code through the site
We reserve the right to suspend, restrict or terminate your access to the website at any time without notice if we believe you have breached these Terms.
The content on our website (including text, menus, images, logos and design) is owned by us or our licensors and is protected by copyright and other intellectual property laws. You may view and print content for personal use only.
- Placing an order You can place orders:
- in person at our shop
- by calling us on the phone
- or through any future online ordering system on the website
When you place an order you are making an offer to purchase the selected items at the prices shown. A binding contract is formed only when we accept your order — this will usually be confirmed verbally (in person/phone), by text message, or by any confirmation message shown on the website.
All items are subject to availability. We will make reasonable efforts to fulfil your order as requested, but we reserve the right to:
- refuse any order
- cancel any order (even after acceptance)
- substitute items of similar quality and value if an item is unavailable
If we cancel an order after payment has been taken, we will refund you in full using the original payment method.
Prices are displayed in British Pounds (GBP) and include VAT where applicable. We may change prices at any time, but price changes will not affect orders we have already accepted.
- Payment Payment is required at the time of ordering or upon collection/delivery. Accepted payment methods include:
- cash
- debit/credit card (in person)
- any other methods we may offer from time to time
If we introduce online card payments in the future, these will be processed securely by a third-party payment provider. We do not store your full card details on our systems.
We reserve the right to refuse any payment or order if we suspect fraud, if your payment method is declined, or for any other legitimate reason.
- Collection and delivery Collection (takeaway):
- Please collect your order at the agreed time. We are not responsible for food quality issues if you collect significantly later than arranged.
- We will hold your order for a reasonable time only.
Delivery (if and when offered):
- Delivery times are estimates only and not guaranteed.
- We are not liable for delays caused by traffic, weather, road closures, incorrect address details, or other factors outside our reasonable control.
- You must provide a complete, accurate and safe delivery address. We reserve the right to refuse delivery if the address is unsafe, inaccessible, or if the recipient is not present.
- Additional delivery charges (if any) will be clearly shown before you confirm the order.
- Food safety, allergies and dietary information We take food safety and hygiene very seriously and follow strict procedures. However, our kitchen handles common allergens (e.g. fish, gluten, dairy, eggs, etc.).
It is your responsibility to:
- inform us of any allergies or dietary requirements when placing your order
- check allergen information with staff if you are unsure
We cannot guarantee that our food is completely free from cross-contamination. If you have a severe allergy, we recommend you speak to us directly before ordering. You order and consume our food at your own risk in relation to allergies.
- Cancellations, refunds and returns Once we have started preparing your order, it cannot normally be cancelled. If you need to cancel, please contact us immediately — we will try to accommodate if preparation has not begun.
Refunds will be given only in these situations:
- we are unable to fulfil your order
- there is a genuine error or quality issue with the food (reported within a reasonable time, ideally on the same day)
Refunds will be processed to the original payment method within 14 days where applicable. No cash refunds for card payments.
We do not offer refunds or replacements for change of mind, or for food that has been consumed or incorrectly stored after collection/delivery.
- Our liability We prepare and serve food to high standards, but:
- we are not liable for any illness, injury, loss or damage caused by improper storage, reheating or handling of food after it leaves our premises
- we are not responsible for indirect or consequential losses (e.g. loss of enjoyment, loss of profit, travel costs, etc.)
- our total liability to you for any single order is limited to the price you paid for that order
Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence
- fraud or fraudulent misrepresentation
- any other liability that cannot be excluded under Scottish law
- Complaints and feedback If you are unhappy with your food, service or experience, please let us know as soon as possible — ideally within 24 hours — by calling us or emailing info@captains-catch.co.uk. We will investigate and aim to resolve the matter fairly and promptly.
- Governing law and jurisdiction These Terms are governed by the laws of Scotland. Any disputes arising from these Terms or your orders will be subject to the exclusive jurisdiction of the courts of Scotland.
- Changes to these Terms We may update or amend these Terms from time to time to reflect changes in our business, law, or website features. The most current version will always be posted here with the “Last updated” date. Your continued use of our website or placing further orders after any changes means you accept the updated Terms.
